Car Accidents

Metairie Car Crash Injury Attorneys

Most car accidents are not "accidents" at all. They are avoidable events that are caused by negligence. Understanding and proving who was at fault for an accident is an important part of your case. Without fault, there is no defendant who is responsible for paying your damages.

At the Ates Law Firm, our lawyers are here to represent you if you have been injured by a distracted driver, a defective roadway, a vehicle defect or any other type of negligence. With law offices in Destrehan and Gretna, our lawyers represent car accident victims in Greater New Orleans, the River Parishes and throughout Louisiana. We offer a free initial consultation to discuss your case.

What You Should Do After an Accident

After an accident has occurred, the insurance company of the other driver will go into a position of trying to lay fault at your feet. This is called "comparative fault." In Louisiana, your eventual settlement or verdict for the damages you have suffered will be reduced by the percent of fault that is ascribed to you. Insurance companies usually seek to blame some of the accident on the injured person, even if the other driver was clearly to blame.

In some cases, innocent statements that you make can be used to show comparative fault. For example, if your car was struck by a driver who ran a red light, the insurance company or its attorney can raise a legal doctrine called "last clear chance" to confer fault on you. Under this doctrine, if you saw or should have seen the car about to run the red light, you had a responsibility to stop or swerve out of the way.

We urge you to drive safely and defensively, but if the unthinkable happens to you, think of us.
